Tabung Amanah Pekerja (TAP) has prosecuted KPMO Services for failing to pay employee contributions under TAP laws.

The owner of the company pleaded guilty to failing to make contribution payments for the TAP Scheme, SCP Scheme and SPK on behalf of its employees within the prescribed period. The offence constituted a breach of Section 23 of the Employee Trust Act (Cap. 167), Section 26 of the Supplemental Contributory Pensions Trust Act (Cap. 276), and Section 31 of the National Retirement Scheme Act (Cap. 273).

Following the guilty plea, the Bandar Seri Begawan Magistrate’s Court imposed a fine of BND3,300.00 and ordered payment of outstanding contributions amounting to BND18,731.75 to TAP. Failure to comply with the court order and settle the outstanding payments may result in a term of imprisonment.

TAP reminds all employers that timely payment of employee contributions is a statutory obligation of every employer. Under Section 23 of the Employee Trust Act (Cap. 167), Section 26 of the Supplemental Contributory Pensions Trust Act (Cap. 276), and Section 31 of the National Retirement Scheme Act (Cap. 273), employers convicted of such offences may be fined not exceeding BND3,000.00 for the first offence and not exceeding BND10,000.00 for second and subsequent offences.

To safeguard the interests and welfare of TAP members, employers are reminded to ensure that contributions are paid no later than the 15th day of the following month. Failure to do so may result in late payment penalties, including dividend loss charges and service fees.
